1. Who we are
Hayina is an electronic platform that connects the customer with the stores of their neighbourhood ("Near you") and with the district warehouse ("Hayina Cloud"). In "Near you" orders the seller is the store and Hayina is an electronic intermediary; in "Hayina Cloud" orders Hayina handles preparation and delivery. 2. Account
- You may browse as a guest; ordering requires an account with a valid email or mobile number.
- You are responsible for keeping your account confidential and for everything done through it.
- You must be an adult (18 years) to order.
3. Orders and prices
- The price, delivery fee and minimum order are shown before you confirm, inclusive of VAT where applicable.
- The store's confirmation of the order is the acceptance of the contract; a store may decline an order because an item is out of stock or outside its working hours, and you are notified.
- The actual weight of fresh products may differ slightly from what is shown.
4. Payment and wallet
- Payment on delivery, or from the Hayina wallet balance that you top up by bank transfer.
- The wallet balance cannot be transferred to another person, and you can request its withdrawal to your bank account from the app.
- Coupons apply under their published terms, and Hayina or the store may stop them at any time.
5. Delivery
Delivery times are estimates. You must provide a correct address and be available to receive the order; failure to receive it for reasons attributable to the customer may lead to cancellation with the delivery fee charged.
6. Cancellation and returns
You may cancel an order from the app before its preparation starts. Returns and refunds follow the returns and refunds policy.
7. Reviews and content
- You rate a product or store once per delivered order, honestly and without abuse.
- Hayina may remove any content that breaches these terms, and restrict accounts that misuse the platform or file repeated malicious reports.
8. Liability
In "Near you" orders the store is responsible for the product's quality and conformity; Hayina mediates any dispute and compensates from the wallet under its policy. Hayina is not liable for indirect damages. This does not affect your rights under the E-Commerce Law and the Consumer Protection Law.
9. Changes and termination
We may amend these terms and notify you in the app; continued use is acceptance. You may delete your account at any time.
10. Governing law and jurisdiction
These terms are governed by the laws of the Kingdom of Saudi Arabia, and the courts of Riyadh have jurisdiction over any dispute after an attempt at amicable resolution through the complaints channel.
